Why in News ? In a landmark decision, all Supreme Court judges, including the Chief Justice of India, have resolved to disclose their assets publicly. This move aligns with the principles enshrined in the 1997 Restatement of Values of Judicial Life, which serves as a cornerstone of judicial ethics in India.
Preservation of Public Faith:
Judges must avoid actions that could undermine public confidence in the judiciary. As the saying goes, “Justice must not only be done but also be seen to be done.”
Non-Political Involvement:
Judges should refrain from contesting elections or holding positions in clubs, societies, or associations.
Professional Impartiality:
Maintaining Aloofness:
Judges should maintain a level of detachment befitting their position, ensuring impartiality in cases.
Avoiding Conflicts of Interest:
Judges must abstain from hearing cases involving friends or family members.
Refraining from Political Commentary:
Judges should avoid expressing views on political matters that might come under judicial scrutiny.
Let Judgments Speak:
Judges should let their decisions reflect their reasoning and avoid engaging with the media.
No Acceptance of Gifts or Hospitality:
Judges should only accept gifts or hospitality from close family and friends.
Disclosure in Financial Matters:
Prohibition on Business Engagements:
Judges should not engage in trade or business activities, directly or indirectly, except for legal publishing or hobbies.
Avoidance of Financial Gains:
Judges must not seek financial benefits related to their office unless they are explicitly entitled to them.
Upholding Dignity:
Judges must recognize they are constantly under public scrutiny and avoid conduct unbecoming of their high office.
The 1997 Restatement of Values of Judicial Life serves as a moral framework to uphold the dignity, impartiality, and integrity of the judiciary. It reinforces the idea that a judge’s conduct, both inside and outside the court, must inspire public trust and confidence in the justice system.
