Court Directive: The Delhi High Court has directed the state government to frame guidelines to secure the property rights of orphaned minors in the Capital. This follows a slew of directions issued on April 2, 2025.
State’s Responsibility: The court has mandated the state to act as the protector and institute all claims and suits on behalf of orphaned minors, ensuring their property rights are protected.
Judicial Emphasis: Justice Subramonium Prasad emphasized that the state must adopt a “helpless victim of circumstances” approach, dealing with these cases with compassion and a sympathetic attitude.
Context of the Case: The directive arose while dealing with two related petitions connected to children who had a history of being physically and emotionally abused by their parents. After their parents’ demise, the minors’ properties were at risk.
Exploitation Concerns: The court noted that minors, represented by advocates Tara Narula and residing in shelter homes, had their properties frittered away, forcing them into a “traumatised and destitute life” due to crimes committed by their parents or state inaction.
Role of Courts: Justice Prasad underscored that courts are “zealous guardians” for the protection of minors and must ensure proper ties are immediately secured so they are not frittered away by unscrupulous relatives or others.
Property Protection: The court stressed the need to secure both movable and immovable property belonging to minor orphans, ensuring they retain their rightful inheritance.
