Article 67(b)

In an unprecedented move, around 60 Opposition MPs from the INDIA bloc submitted a notice seeking the removal of Vice President Jagdeep Dhankhar as Rajya Sabha Chairperson, citing extreme bias and a six-point charge sheet. They alleged he had repeatedly interrupted Opposition MPs and denied legitimate requests by Leader of the Opposition Mallikarjun Kharge. The notice accused him of lowering the prestige of his office by acting as a spokesperson for the government.

The provision related to the removal of the Vice President of India under Article 67(b) of the Indian Constitution states that:

  • The Vice President can be removed from office only through a resolution passed by the Rajya Sabha and ratified by the Lok Sabha.
  • The removal resolution must be passed by an effective majority in the Rajya Sabha (majority of the total membership) and a simple majority in the Lok Sabha (majority of members present and voting).
  • The resolution must be supported by at least 14 days’ notice before being introduced.

Key Points:

  1. Article 67(b) does not specify “no-confidence motion” but outlines the process for the removal of the Vice President.
  2. The process is not directly linked to their performance as Chairperson of the Rajya Sabha (ex officio role).
  3. Grounds for removal are not explicitly defined in the Constitution, leaving them to the discretion of the Parliament.
