Why in News ? The Kerala High Court observed that when the Investigating Officer submitted the report under Section 173(2) CrPC with the finding that there was no sufficient ground for entering on an investigation against some of the accused, the Magistrate ought to have issued notice to the informant /victim regarding the said finding.
About Section 173(2) of the Code of Criminal Procedure (CrPC):
It deals with the submission of the final report by the investigating officer to the Magistrate after completing the investigation.
Key Points:
Timeframe: The investigation must be completed without unnecessary delay, and the report should be submitted promptly after completion.
Report Contents: The report should be in the form prescribed by the State Government and include:
Confidential Information: If the investigating officer believes that any part of a statement is irrelevant or that its disclosure to the accused is not essential in the interests of justice, they can request the Magistrate to exclude that part from the copies provided to the accused.
Supplementary Charge-sheet: If the investigating officer finds additional evidence after submitting the final report, they can seek permission from the Court to conduct further investigation and file a supplementary charge-shee
Relevant judicial pronouncements with respect to Section 173 CrPC :
In the case of Vinubhai Haribhai Malviya & Ors v. State of Gujarat & Another (2019) 17 SCC, the High Court’s judgement was set aside by the Supreme Court.
सीआरपीसी की धारा 173(2) :
चर्चा में क्यों? केरल उच्च न्यायालय ने पाया कि जब जांच अधिकारी ने सीआरपीसी की धारा 173(2) के तहत रिपोर्ट प्रस्तुत की, जिसमें पाया गया कि कुछ आरोपियों के खिलाफ जांच शुरू करने के लिए पर्याप्त आधार नहीं है, तो मजिस्ट्रेट को उक्त निष्कर्ष के बारे में मुखबिर/पीड़ित को नोटिस जारी करना चाहिए था।
न्यायालय ट्रायल कोर्ट के निर्देशों के आधार पर दर्ज एक आपराधिक पुनरीक्षण मामले की सुनवाई कर रहा था।
न्यायमूर्ति के. बाबू की पीठ ने कहा, “…जब जांच अधिकारी ने धारा 173(2) के तहत रिपोर्ट प्रस्तुत की, जिसमें पाया गया कि कुछ आरोपियों के खिलाफ जांच शुरू करने के लिए पर्याप्त आधार नहीं है, तो मजिस्ट्रेट को उक्त निष्कर्ष के बारे में मुखबिर/पीड़ित को नोटिस जारी करना चाहिए था।”
दंड प्रक्रिया संहिता (सीआरपीसी) की धारा 173(2) के बारे में:
यह जांच अधिकारी द्वारा जांच पूरी करने के बाद मजिस्ट्रेट को अंतिम रिपोर्ट प्रस्तुत करने से संबंधित है।
मुख्य बिंदु:
समय-सीमा: जांच बिना किसी अनावश्यक देरी के पूरी होनी चाहिए, और रिपोर्ट पूरी होने के तुरंत बाद प्रस्तुत की जानी चाहिए।
रिपोर्ट की विषय-वस्तु: रिपोर्ट राज्य सरकार द्वारा निर्धारित प्रारूप में होनी चाहिए और इसमें शामिल होना चाहिए:
गोपनीय जानकारी: यदि जांच अधिकारी का मानना है कि बयान का कोई हिस्सा अप्रासंगिक है या अभियुक्त के सामने उसका खुलासा न्याय के हित में आवश्यक नहीं है, तो वे मजिस्ट्रेट से अनुरोध कर सकते हैं कि वह अभियुक्त को प्रदान की गई प्रतियों से उस हिस्से को बाहर कर दे।
पूरक आरोप-पत्र: यदि जांच अधिकारी को अंतिम रिपोर्ट प्रस्तुत करने के बाद अतिरिक्त साक्ष्य मिलते हैं, तो वे आगे की जांच करने और पूरक आरोप-पत्र दाखिल करने के लिए न्यायालय से अनुमति मांग सकते हैं।
धारा 173 सीआरपीसी के संबंध में प्रासंगिक न्यायिक घोषणाएँ:
समाज परिवर्तन समुदाय बनाम केरल राज्य (2012) 7 एससीसी 407 के मामले में, भारत के सर्वोच्च न्यायालय ने माना कि यदि किसी मामले की जांच के प्रभारी पुलिस अधिकारी को कोई अतिरिक्त जानकारी या साक्ष्य मिलता है, तो उसके लिए उसे निर्धारित प्रारूप में पूरक रिपोर्ट के साथ मजिस्ट्रेट को भेजना अनिवार्य है। यह भी देखा गया कि पुनः जांच की अनुमति नहीं है, लेकिन आगे की जांच निषिद्ध नहीं है।
विनुभाई हरिभाई मालवीय और अन्य बनाम गुजरात राज्य और अन्य (2019) 17 एससीसी के मामले में, उच्च न्यायालय के फैसले को सर्वोच्च न्यायालय ने खारिज कर दिया। इस आधार पर एफआईआर दर्ज की गई थी कि विनुभाई के कानूनी उत्तराधिकारियों ने सूरत में जमीन के मूल्य में वृद्धि के कारण जमीन के संबंध में पावर-ऑफ-अटॉर्नी बनाकर साजिश रची है। आरोपियों ने जमीन के कानूनी मालिकों से जमीन हड़पने की कोशिश की थी। सर्वोच्च न्यायालय का मानना था कि मजिस्ट्रेट किसी मामले के संज्ञान के बाद भी दंड प्रक्रिया संहिता की धारा 156 (3) के तहत अपनी शक्ति का इस्तेमाल कर सकता है।
